Terms and Conditions (“Conditions”)

 

Please read these terms and conditions carefully before using FunTech
Website, managed by Concept Combined General Trading &
Contracting Company – Kuwait

 

Your access to the service and using it is
conditional upon your acceptance of these terms and conditions and comply with
them. These conditions apply on all visitors, users and others who access or
use the service.

 

Through the access or use of the service or
accessing our website/application, you agree without reservation to comply with
these terms and conditions. If you do not approve any part of the conditions,
you are not eligible to access the service.

Accounts:

 

Upon creating an
account with us, you should provide us with accurate, complete and recent
information at all the times. Failing do so is considered as a breach of the
conditions, which may lead to the immediate termination of your account on our
service.

 

You are responsible for
maintaining the password that you use to access the service and for any
activities or actions by using your password, whether your password is with our
service or a third-party service.

 

In all cases, you will
be fully responsible for your account, even if you do not use it, until the
date we are notified of a breach or unauthorized access to your account and our
taking of action in this regard.

 

You agree not to
disclose your password to any third party. You must notify us immediately upon
becoming aware of any breach of security or unauthorized use of your account.

 

Accuracy of
billing, account and payment information

 

We reserve the right to
refuse any order you submit to us without providing any justification. We may,
at our sole discretion, limit or cancel quantities purchased per person, per
household or per order. These restrictions may include orders placed by or
through the same customer account, the same KNET or Visa / Mastercard credit
cards, and/or orders using the same billing and/or shipping address.

 

You agree to provide updated,
complete and accurate purchase and account information for all purchases made
in our store. You agree to promptly update your account and other information,
including your phone number, so that we can complete your transactions and
contact you as needed. You also agree that we may request more information to
verify your purchase. This may include, but is not limited to, photo
identification, proof of address, telephone verification, or otherwise.

 

In some cases, we have
to review your order manually to verify your identity. Due to the digital
nature of some of our products, we make every effort to ensure that the person responsible
for the payment method is the person who placed the order or authorized the
payment. We work closely with payment processors and authorities to combat
online fraud and report suspicious activity.

 

If you fail to verify
your identity, we may have to report it as a fraudulent transaction to your
payment processor immediately and blacklist your submitted details, which may
result in your payment method being suspended. Refusal to verify identity is
not only a breach of these terms and conditions, but may also be reported as
unauthorized use of the payment account.

Our service may contain
links to third-party websites or online services that are not owned or
controlled by FunTech.

 

FunTech has no control
over the content and assumes no responsibility for the contents, privacy
policies or practices of any third party websites or services.

 

You also acknowledge
and agree that FunTech shall not be responsible or liable, directly or
indirectly, for any damage or loss caused or alleged to be caused by or in
connection with the use of or reliance on any such content, goods or services
available on any such websites. or through the services.

 

We strongly advise you
to read the terms and conditions and privacy policies of any third-party
websites or services that you visit.

 

Returns and
exchanges policy

Digital cards

·      
No refunds are made for digital products.

·      
It is not possible to exchange when the
area or type is requested by mistake.

·      
Exchange is only allowed if the code is
incorrect.

·      
In unexpected cases where the code you
receive does not work, please send a screenshot of the error message you received
and your order details to: support@concept-kw.com and we will study your
complaint and provide you with a solution as soon as possible.

·      
We endeavour to respond to all complaints
within one or two business days. In some cases, where we need to get the error
report from the supplier company, the waiting time may take from 4 to 5 working
days or more.

Physical products and accessories

 

•    
You can return most new, unopened products
sold within 14 days of delivery for a full refund. We will also pay for the
return shipping costs if the reason for the return is due to an error on our
part, otherwise the two-way shipping fee will be charged. The return request
can be submitted via the site (contact us) by e-mail or phone. Products must be
returned in the original product packaging.

•    
You will get your money back after we
receive and confirm the items returned. You should expect to get your money
back within 4 weeks of your shipment being delivered to the shipping authority
(noting that in most cases refunds will be made sooner).

 

Changes:

 

We reserve the right,
at our sole discretion, to modify or replace these terms and conditions at any
time. Should an amendment be required, we will attempt to provide at least 30
days’ notice before any new terms become effective. A material change will be
determined by our sole discretion.

 

By continuing to access
or use our service after such modifications become effective, you agree to be
bound by the modified terms. If you do not accept the modifications to the
terms, please stop using this service.

 

Upon your request to obtain our service or
access our website/platform, this is considered as a final and irrevocable
approval from you of the terms and conditions set forth in connection with this
service or website.

 

Upon your access to our
website/platform/application, this is considered as an authorization to us to
obtain your information and using it in a manner which does not contravene the
laws, and keep a copy thereof.

 

If you wish to cancel the account, this feature
is available with the deletion of all the saved data.

 

You should take at all the times all actions to
protect your programs, system, information, funds, credit cards, banking cards,
purchases and valuable things. You should also take all measures to prevent
losses in the event of occurrence of leakage, hacking, entry of virus, wrong
usage or other similar cases to the foregoing. In all cases, our
website/platform/application does not provide any guarantees regarding the
protection of your information from leakage, penetration, virus or misuse, all
of which are considered among the risks that you agree to upon obtaining the
service or accessing the site/platform/application.

 

While we do our best to provide the service, we
do not warrant or guarantee, expressly or implicitly the availability of the
services, the completeness, accuracy, reliability, suitability, suitability for
the purpose, absence of errors, intrusions or the like with respect to the
services and facilities offered.

 

In no event shall we be liable for any loss or
damage, direct or consequential, or for lost profit, or special damage caused
by direct, incidental, indirect, or intentional damage, whether contractual or
by law, arising out of or in connection with this service or your access to our
websites, platforms and application (and/or) failure to perform,
non-performance, unavailability, interruption, stop (and/or) disconnection of
service, whether towards you (and/or) towards third persons, whether this risk,
loss or damage is  expected or not.

 

 

You shall be liable alone for all the
responsibilities related to the use of any credit card, Knet card, debit card,
bank card, or any other cards, subscriptions or accounts designated for
payment, whether used by you or by others. In the event of robbery, theft or
loss of any of these cards or accounts or subscriptions, you bear the resulting
responsibilities and are obligated to compensate us for losses and damages
resulting from their use.

 

In the event of claims or filing lawsuits as a
result of this service, requesting the same and your access to our websites,
platforms and application, the maximum limit for losses and compensations (of
all kinds) that may be payable to you is a maximum of 10% of the total
purchases, including, but not limited to, theft of information or funds, loss
of money, loss of clients, lost profit, damages, direct or indirect losses, and
compensations of all kinds that result from any breach, violation, errors, or
others, provided that the default and compensations are confirmed by a final
and conclusive court judgment. Further, you hereby waive all of the
above-mentioned rights according to a final waiver for everything that exceeds
the above-mentioned maximum limit.

 

The relationship between both parties is governed
by the laws in force in the State of Kuwait. The courts of Kuwait are
exclusively competent to hear any dispute that arises in connection with the
relationship between us, the services we provide and their use, or your access
to the site/platform/application. Both parties irrevocably waive any rights
they have to refer to other laws or other courts.

 

These terms and conditions and conditions are
considered as a contract between you and us regarding your access to our
website/platforms/ application and your request for services.
